Statement of significance:


	Large former bay side hotel of considerable historical and architectural worth, which remains virtually intact from early Victorian times. Building begun by Thomas Kellet and J Drew in 1840 had by the 1850s developed gardens, private zoo and provision for outdoor sports. Became a popular weekend and holiday pleasure ground. Bought in 1884 by entrepreneur Frank Smith who set up famous running races from 1884-92, passed into hands of breweries who auctioned it to present owners in 1926. Construction years:	1840-1874
Physical description:	Site: 0.88 acres existing area (0.356ha) (Thorp and Staas, 1998, 9). Large complex of stuccoed brick building. First part begun in 1840, two storey Georgian building. With fine central door and fanlight with flanking single storey wings, named the Banks Inn. About 1860, further single storey wing to east was added with curved faade and verandah, steeply pitched hipped roofs. Main two storey c1870 north wing added in Italianate style, heavily ornamented with slab. Parapets and two storey cast iron verandahs, interior, carved cedar (AHC)
Modifications and dates:	1840 Banks Inn built. By the 1850s it had developed gardens, a private zoo and provision for outdoor sports. It became a popular pleasure ground. c1860, a further single storey wing to east was added with curved facade and verandah. c1870 Main two storey north wing added in Italianate style. 1908 CBC sold the hotel and grounds of c.26acres in 11/1908 to new company, Sir Joseph Banks Estate Ltd. This (company) began to sell the remaining 25 acres that remained from the original hotel property. A major subdivision of 14 acres was approved in 1921. This involved formation of Fremlin Road from an existing lane and construction of Anniversary Road in front of the old hotel as well as Tupia Street and Wararah Road. This new subdivisoin encompassed 56 residential blocks and 39 commercial ones, the latter along Botany Road. The old hotel occupied lots 6-11 in section 3 of the subdivision. The residential lots were gradually sold between 1923 and 1931 - the last commercial lot was not sold until 1946 and then only because the Housing Commission purchased several and erected blocks of flats on them. From 1908-28 site known as the Olympic Recreation and Picnic Grounds. (Thorp and Staas, 1998, 13, 14). The hotel was not sold during this period of activity. It was a large building, difficult to find a use for and becoming increasingly detacted from the grounds and surrounding which had contributed to its past success. By the mid-1920s it was sharing the street with several houses. In 1920 the Banks Meadow Parents and Citizens' Association urged Botany Council to acquire the 11 acres of the Sir Joseph Banks Estate situated between the hotel and a reservation on the foreshore. Council made representation to the state government for financial assistance and in 1926 bought this area from the Sir Joseph Banks Estate Ltd. for 1700 pounds of which 790 was contributed by state government. The sites of the gardens, menagerie, running tracks and grandstand were then developed as a public park. Its entrance was opened in 1933 (Thorp & Staas, 1998, 14).

History

Historical notes:

The "Eora people" was the name given to the coastal Aborigines around Sydney. Central Sydney is therefore often referred to as "Eora Country". Within the City of Sydney local government area, the traditional owners are the Cadigal and Wangal bands of the Eora. There is no written record of the name of the language spoken and currently there are debates as whether the coastal peoples spoke a separate language "Eora" or whether this was actually a dialect of the Dharug language. Remnant bushland in places like Blackwattle Bay retain elements of traditional plant, bird and animal life, including fish and rock oysters (Anita Heiss, "Aboriginal People and Place", Barani: Indigenous History of Sydney City http://www.cityofsydney.nsw.gov.au/barani).

With the invasion of the Sydney region, the Cadigal and Wangal people were decimated but there are descendants still living in Sydney today. All cities include many immigrants in their population. Aboriginal people from across the state have been attracted to suburbs such as Pyrmont, Balmain, Rozelle, Glebe and Redfern since the 1930s. Changes in government legislation in the 1960s provided freedom of movement enabling more Aboriginal people to choose to live in Sydney (Anita Heiss, "Aboriginal People and Place", Barani: Indigenous History of Sydney City http://www.cityofsydney.nsw.gov.au/barani).

Seaside resort:
Large former bayside hotel of considerable historical and architectural worth, which remains virtually intact from early Victorian times. The building was begun by Thomas Kellet and J Drew in 1840, it (then known as the Banks Inn) had by the 1850s developed pleasure gardens, a private zoo and provision for outdoor sports. It became a popular weekend and holiday pleasure ground.

About 1860, a further single storey wing to east was added with curved facade and verandah, steeply pitched hipped roofs. Main two storey c 1870 north wing added in Italianate style, heavily ornamented with slab. Parapets and two storey cast iron verandahs, interior, carved cedar.

In the late 1860s the proprietor set out to make the hotel the leading sports ground of the metropolis (HCoNSW, 1987, 3).

It was bought in 1884 by entrepreneur Frank Smith who set up famous running races from 1884-92, it passed into hands of breweries who auctioned it to present owners in 1926 (AHC, c1991).

Athletic and sporting events were expanded and the first St.Patrick's Day celebrations were held. The first 100 yard handicap was run as part of these celebrations in 1884 for a prize of 10 pounds. The event was so successful that Smith concluded that foot-racing for good prize money would be a paying venture and an added attraction for the hotel. Cinder running lanes, separated by narrow grassed strips, were laid down for a 150 yards straight dash on the eastern end of the flat which now forms part of Sir Joseph Banks Park. A grandstand and a large pavilion were erected at the eastern end of the park near Fremlin Street (ibid, 1987, 8).

The first Sir Joseph Banks Handicap, with 150 pounds prize money was held on 10 May 1884. Tom Malone, an Irish 'ped' of international repute, competed but failed to gain a place. The rules for this event became the accepted standards for professional athletics throughout the state. The races were popular, with high attendances and a considerable amount of money being wagered at the track. Four major handicaps and many minor events were held every year. The Tattersalls Club conducted sweeps on the major events and on some occasions horse racing clubs arranged their programs so as not to clash with the major events. The third handicap, run in March 1885, saw the prize money raised to 500 sovereigns and a 50 guinea gold cup. G. Black, an Aboriginal, won this race from the favourite, Jim Byrne. Byrne protested and Black was disqualified on the ground that his entry form was incorrect - he had claimed to be 35 and to have never won a prize, when in reality he was not more than 23 and had won several handicaps (ibid, 1987, 8).

From 1885-1890 professional sprint events boomed. The Banks track attracted runners from all over the world. Thousands would travel to Botany to witness world-class athletes like England's Harry Hutchins and Lou Meyers from the USA compete against local Aboriginal runners Charlie Samuels and Bob McDonald, as well as Jim McGarrigal, Ted Lazarus and many others. Over the years, the amount of wagering increased and many sharp practices developed and were exposed. This resulted in a rapid decline in the public popularity of professional sprinting. The last Sir Joseph Banks Grand Handicap was held on 14 June 1892. The following year Smith died and the Banks foot races ceased (ibid, 1987, 3).

As part of the 1988 Bicentennial celebrations,a reenactment of the Sir Joseph Banks Race Meeting was held on 13 March 1988 at the Sir Joseph Banks Hotel. The 'Bay Gift' as the race was renamed, was arranged by the NSW Athletics League as a professional 120m handicap. With the help of a $200,000 grant from the NSW Bicentennial Council, Botany Municipal Council recreated the hotel's once-famous (pleasure) gardens and running track. The 1988 race was open to members of the NSW Athletics League. It was hoped that it would become an annual foot race like the Stawell Gift in Victoria (ibid, 1987, 3).

57(2)	Exemption to allow work	Standard Exemptions	HERITAGE ACT 1977 ORDER UNDER SECTION 57(2) TO GRANT STANDARD EXEMPTIONS FROM APPROVAL I, Penny Sharpe, the Minister for Heritage, on the recommendation of the Heritage Council of New South Wales and under section 57(2) of the Heritage Act 1977: revoke the order made on 2 June 2022 and published in the Government Gazette Number 262 of 17 June 2022; and grant an exemption from section 57(1) of the Act in respect of the engaging in or carrying out the class of activities described in clause 2 Schedule A in such circumstances specified by the relevant standards in clause 2 Schedule A and General Conditions in clause 3 Schedule A. This Order takes effect on the date it is published in the NSW Government Gazette.
